The Fourth Successful Edition of this much celebrated compendium of land laws titled "Handbook of Land Tenure in Tamil Nadu" bears a valuable foreword by Hon'ble Mr.Justice D.Murugesan from which a portion is reiterated hereunder for readers' quick understanding about this book.

 

In his foreword, Mr.Justice has written that, "the right to own, possess and enjoy the land was declared to be a fundamental right guaranteed under Article 19 (1) (f) of the Constitution of India. The clause relating to the fundamental right was omitted by the Forty-fourth Constitution Amendment Act, 1978 when Article 300-A was inserted. Right to property was made a Constitutional right and such right is an invaluable right possessed by the citizens. Property right may vest either on owners, tenants, allottees, assignees or even in some cases on encroachers. Nevertheless, these rights are regulated by the various enactments such as the Tamil Nadu Agricultural Lands (Record of Tenancy) Rights Act, 1969 with regard to the tenancy rights and the Tamil Nadu Cultivating Tenants Protection Act, 1955 regarding the cultivating tenants. The Government, in view of the directive principles of State policy, obligated to provide adequate means of livelihood to the downtrodden people by providing facilities of house sits, roads, burial ground, etc., and had enacted the Tamil Nadu Acquisition of Land for Harijan Welfare Schemes Act, 1978. Various laws regulate such right of individuals and most of us do not know the enactments which confer rights over the land."

 

While highlighting the efforts made by the twin Authors Dr.S.Sambandham, District & Sessions Judge (Retd.) and V.S.Rajaram, B.A., L.L.B., Advocate, High Court of Madras, Hon'ble Mr. Justice D.Murugesan said that "the present compilation of the provisions of the various enactments concerning the land with reference to the right of the owners, occupants, tenants, encroachers etc., is a new attempt and is certainly appreciable. The book would be of immense use to not only the lawyers who practice in various branches relating to the rights of the individuals over their lands, but also the individuals themselves. The authors have made efforts by not only providing the original provisions of the various enactments but also the subsequent amendments. Wherever possible, the authors have also given the citations regarding judgments on the respective provisions."

 

Thus the above words from the foreword reveals the significance and usefulness of this mega book containing 1756 pages. Kudos to the learned Authors who have taken much pain to bring the Acts and Rules relating to land tenure in Tamil Nadu in a single volume totalling 70 such legislations with latest amendments and judgments.

 

It is a must book for each and every Advocate Office and the Bench for quick reference, besides for law students and general public.
