A new Criminal Rules of Practice were framed by the High Court of Madras in the year 2019 by repealing the old Criminal Rules of Practice and Circular Orders 1968.
While the new rules are being followed, the Supreme Court of India gave a direction under Article 141 of the Constitution to amend the CRP of every state in In re: To Issue Certain Guidelines Regarding Inadequacy and Deficiencies in Criminal Trials Vs. State of Andra Pradesh and Others, 2021 (6) SCALE 63 : 2021 (3) KLT 191 (SC) so as to rectify the deficiencies in Criminal Trial. By taking into account the said judgment, the High Court of Madras amended Rules 10, 12, 25, 43, 49, 58, 106, 149, 221 and 252 and also inserted Rule 26-A and Chapter VIII-A (Rules 34-A to 34-C) which was published in the Tamil Nadu Government Gazette, dated 23-03-2022. It came into force on the same date of gazette publication. Hence, from that date onwards, the amended Criminal Rules of Practice 2019 have to be followed by the criminal courts in the State of Tamil Nadu and Union Territory of Puducherry and the Appellate Side of High Court of Madras and Madurai Bench of of the High Court of Madras.
Thus this book is completely revised on the basis of the said amendments.
